Online Filing Reminder and Update

Over the course of 2022, in an effort to improve efficiency and access to its services, the Commission introduced online filing for the following Commission forms:

·        Unfair Dismissal Application

·        Employer’s Response to Unfair Dismissal Application

·       Notification of an Industrial Dispute

·       Notice of Appeal – Public Sector Discipline

·        Employer’s Response – Public Sector Discipline.

The following UCPR forms may also be filed online in lieu of the Commission forms:

·        Notice of Appearance (UCPR Form 6A) (in lieu of IRC Form 37)

·        Notice of Discontinuance (UCPR Form 33) (in lieu of IRC Form 38)

·        Notice of Change of Solicitor or Appointment of Solicitor (UCPR Form 77) (in lieu of IRC Form 45)

·        Notice of Removal of Solicitor (UCPR Form 78)

·        Notice of Intention to File Notice of Ceasing to Act (UCPR Form 79) (in lieu of IRC Form 45)

·        Notice of Ceasing to Act (UCPR Form 80) (in lieu of IRC Form 45).

We encourage parties to use these online forms and to familiarise themselves with the above UCPR forms. The forms and information about online filing generally can be accessed at: https://www.irc.nsw.gov.au/irc/practice-and-procedures/file-online.html. The Commission forms which correspond to these UCPR forms will be removed from the Commission’s website later this year.

The Registry will continue to accept hard copy filing at Parramatta and by post.  However, from 1 March 2023, with the exception of Notification of an Industrial Dispute forms, the Registry will only accept documents filed by email if leave of the Commission has been granted in advance.

Initiating process documents or applications which must be filed within a time period specified by legislation (including but not limited to unfair dismissal applications, victimisation claims, public sector disciplinary appeals, and applications for review of removal pursuant to s 181D of the Police Act 1990) may be filed at the Local Courts. Provided that these applications comply with all procedural requirements specified by legislation and by the Commission, such documents will be taken to be filed at the Commission on the date they are received by the Local Court.
