As part of its ongoing review of its procedures, forms and practice notes, the Commission has recently considered its "usual directions". The Commission may make such directions as it considers appropriate for the just resolution of the issues between the parties. When programming a matter for arbitration, the Commission will make directions for the timetabling of the hearing of the matter. The Commission has issued “Usual Directions” which, in the ordinary course, will be made by the Commission. A copy of the “Usual Directions” can be found here.
The Commission has also reissued Practice Note 32, such that the requirements and limitations set out in Schedule A of the Practice Note now apply to any directions given by the Commission in relation to the filing of evidence and submissions, unless leave to be excused from the requirements of the Practice Note is granted by the Commission. Practice Note 32 can be found here.
The Commission is working through existing Practice Notes and will update these where appropriate to reflect the new "Usual Directions".
